Seller Agreement
Effective Date: February 4, 2026
This Seller Agreement is a legal contract between you (“Seller,” “you,” or “your”) and ReMerch Search. By creating a seller account, listing items for sale, or participating in auctions on our platform, you agree to abide by the terms outlined below. This agreement is designed to ensure a marketplace built on authenticity, transparency, and a shared passion for music history.
1. Eligibility and Account Verification
To maintain the security of our community, all sellers must meet specific eligibility requirements:
Account Standing: You must be at least 18 years of age and capable of entering into legally binding contracts.
Verification: Sellers may be required to provide government-issued identification, proof of address, and valid tax information.
Payment Integration: You must link a valid bank account or supported digital wallet via our third-party payment processors to receive payouts.
Single Account Policy: Users are generally limited to one seller account unless prior written approval is granted by ReMerch Search.
2. Listing Standards and Seller Responsibilities
As a seller on ReMerch Search, you are responsible for the accuracy and legality of every item you list.
Honest Descriptions: You must provide a complete and accurate description of the item’s condition. You are required to disclose any and all flaws, including but not limited to: scratches, skips, tears, stains, fading, or restoration work.
Original Imagery: You must use high-quality, original photographs of the actual item in your possession. The use of stock photos, “mock-ups,” or images stolen from other sellers is strictly prohibited and may lead to account suspension.
Accurate Categorization: Items must be listed under the correct Artist, Genre, and Category. Misleading categorization to gain visibility is considered a violation of these terms.
3. Authenticity and Provenance
ReMerch Search is a dedicated marketplace for authentic music memorabilia.
Authenticity Guarantee: By listing an item, you warrant that it is an authentic product as described. Selling counterfeit, “bootleg,” or unauthorized reproductions passed off as originals is a violation of federal and international law and will result in a permanent ban.
Signed Items: For autographed memorabilia, sellers must provide details regarding provenance or any accompanying Certificates of Authenticity (COA). ReMerch Search reserves the right to remove any listing where authenticity is reasonably questioned.
Intellectual Property: You represent that you have the right to sell the item and that the sale does not infringe upon the copyrights or trademarks of any third party.
4. Shipping and Fulfillment
Timely shipping is the backbone of buyer trust.
Shipping Deadline: You agree to ship sold items within three (3) business days of receiving a payment notification.
Tracking Requirement: All items must be shipped using a tracked service. You must upload the tracking number to the ReMerch Search dashboard immediately upon shipping.
Safe Packaging: You are responsible for ensuring items are packaged securely. Vinyl records, posters, and fragile collectibles must be shipped in industry-standard mailers to prevent damage during transit.
5. Fees, Payouts, and Financial Terms
Platform Fees: ReMerch Search charges a commission fee on the total transaction amount (including shipping). These fees are outlined in the Fees and Payments policy and are deducted automatically at the time of sale.
Escrow Period: To ensure buyer satisfaction and prevent fraud, ReMerch Search holds funds in escrow. Payouts are typically released to the Seller’s account 7 days after the tracking number confirms “Delivered” status, provided no dispute has been opened.
Chargebacks and Refunds: If a buyer wins a dispute for an item “Not as Described,” the Seller is responsible for the refund and the cost of return shipping.
6. Seller Conduct and Prohibited Acts
Off-Platform Transactions: You may not use ReMerch Search to find buyers and then complete the transaction outside of our checkout system to avoid fees. This is known as “fee avoidance” and will result in immediate termination of your account.
Shill Bidding: You may not bid on your own auction listings or use associates to artificially inflate the price of your items.
Communication: All communication with buyers must remain professional and take place within the ReMerch Search messaging system.
7. Disputes and Indemnification
In the event of a dispute with a buyer, you agree to cooperate with the ReMerch Search mediation team. You agree to indemnify and hold ReMerch Search harmless from any claims, losses, or damages resulting from your breach of this agreement, your sale of counterfeit goods, or your violation of any third-party rights.
8. Termination
ReMerch Search reserves the right to suspend or terminate your seller privileges at any time, with or without notice, for any violation of this agreement or for maintaining a high rate of buyer dissatisfaction.
