Terms and Conditions

Welcome to ReMerch Search. By accessing our website (the “Site”) and using our services, including the marketplace, auction platform, and community features (collectively, the “Services”), you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.

1. The Nature of the Marketplace

ReMerch Search provides a specialized online platform for collectors and fans to buy and sell music memorabilia, including but not limited to vintage apparel, vinyl records, posters, and signed items.

1.1 Platform Role: ReMerch Search acts as a venue only. We are not an auctioneer, and we are not the seller of the items listed by users. The actual contract for sale is directly between the Buyer and the Seller. 1.2 Verification: While we employ verification processes for sellers, we do not physically possess, inspect, or guarantee the authenticity, safety, or legality of items listed by third-party users.

2. User Accounts & Eligibility

2.1 Age Requirement: You must be at least 18 years old to create an account or use our Services. 2.2 Account Accuracy: You agree to provide accurate, current, and complete information during the registration process. 2.3 Security: You are solely responsible for safeguarding your password. ReMerch Search is not liable for any unauthorized access to your account resulting from your failure to maintain password security.

3. Selling on ReMerch Search

All sellers must adhere to the following standards to maintain the integrity of our music community.

3.1 Listing Accuracy: Sellers must describe items honestly. All flaws, damage, or restoration must be clearly photographed and noted in the description. 3.2 Authenticity Guarantee: By listing an item, the Seller represents and warrants that the item is authentic. The sale of counterfeit goods, “fakes,” or unauthorized reproductions passed off as originals is strictly prohibited. 3.3 Fulfillment: Sellers agree to ship sold items within three (3) business days of receiving notification of payment. 3.4 Prohibited Items: Sellers may not list items that are illegal, hazardous, or infringe on the intellectual property rights of others.

4. Buying and Bidding

4.1 Binding Offers: When you click “Buy Now” or win an auction, you are entering into a legally binding contract to purchase that item from the Seller. 4.2 Payment: Buyers must pay for items through the ReMerch Search secure checkout system. Off-platform transactions are strictly prohibited and will result in the loss of Buyer Protection. 4.3 Auctions: Bids cannot be retracted once placed. In the event of a dispute regarding a winning bid, ReMerch Search’s records shall be the final authority.

5. Fees and Taxes

5.1 Seller Commission: ReMerch Search charges a transaction fee (commission) on every successful sale. This fee is deducted from the final sale price before the payout is issued to the Seller. 5.2 Taxes: Buyers are responsible for any sales tax, VAT, or customs duties applicable to their purchase based on their location. 5.3 Fee Changes: We reserve the right to change our fee structure at any time with 30 days’ notice via email or Site announcement.

6. Intellectual Property

6.1 Site Content: All text, graphics, logos, and software on the Site are the property of ReMerch Search or its content suppliers and are protected by international copyright laws. 6.2 User Content: By posting photos or descriptions of items, you grant ReMerch Search a non-exclusive, worldwide, royalty-free license to use that content for marketing and promotional purposes.

7. Prohibited User Conduct

Users agree not to:

  • Use the Site for any fraudulent or illegal activity.

  • Attempt to bypass ReMerch Search’s fee structure by completing sales off-site.

  • Use “shill bidding” (bidding on your own items or having associates bid) to artificially inflate prices.

  • Harass, threaten, or abuse other members of the community.

  • Upload viruses or malicious code that may interfere with the Site’s functionality.

8. Buyer Protection and Disputes

8.1 The “Not as Described” Guarantee: If a Buyer receives an item that differs significantly from the listing, they may open a dispute within 7 days of delivery. 8.2 Resolution: ReMerch Search reserves the right to mediate disputes. Our decision regarding refunds, returns, or credits is final and binding. 8.3 Refunds: Approved refunds will be processed back to the original payment method once the item has been returned to the Seller (if applicable).

9. Disclaimers and Limitation of Liability

9.1 “As Is” Basis: The Site and Services are provided on an “as is” and “as available” basis without any warranties of any kind. 9.2 Limitation of Liability: To the fullest extent permitted by law, ReMerch Search shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, arising out of your use of the platform.

10. Termination

We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the business interests of ReMerch Search.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of [Insert Your Country/State], without regard to its conflict of law provisions.
